1. Who We Are

Mo Bamba Cards and Collectibles LLC ("Mo Bamba Cards & Collectibles," "we," "us," or "our") operates the website at https://mobambacollects.com and a retail store located at 2350 Guadalupe St, Austin, TX 78705. We sell sports cards, sealed wax products, memorabilia, and collectibles, and we provide card grading submission, buying, and trading services.

This Privacy Policy explains what personal information we collect, why we collect it, how we use and share it, and what choices and rights you have. It applies to our website, our online store, our physical retail location, and our text message and email communications.

If you do not agree with this Policy, please do not use our website or services.


2. Information We Collect

2.1 Information you give us directly

  • Identity and contact information — your name, email address, mailing address, billing address, shipping address, and phone number (including mobile number, if you provide one).
  • Account information — your username, password, and account preferences if you create an account with us.
  • Order and transaction information — the items you purchase, order value, order history, pickup or shipping preferences, and any notes you add to an order.
  • Grading and buy/trade information — descriptions and photographs of cards or memorabilia you submit for grading, sale, or trade; declared values; submission and tracking numbers; and payout details.
  • Payment information — see Section 3 below. We do not store full payment card numbers.
  • Communications — messages you send us through our contact form, by email, by text message, by phone, or in person, including the content of those messages.
  • Marketing preferences — whether you have opted in to our email newsletter ("MoBamba News") or to text messages, and any later changes to those choices.
  • Event participation — your registration for in-store events such as trade nights, card breaks, and community gatherings.

2.2 Information collected automatically

When you visit our website, we and our service providers automatically collect:

  • Device and connection data — IP address, browser type and version, operating system, device type, and screen resolution.
  • Usage data — pages you view, products you browse, items added to your cart, links you click, search terms you enter, referring website, and the dates and times of your visits.
  • Cookies and similar technologies — see Section 7.

2.3 Information from third parties

  • Payment and fraud data from our payment processors, such as confirmation that a payment succeeded, a partial card number (last four digits), card brand, and fraud or chargeback signals.
  • Shipping data from carriers, such as delivery confirmation and tracking status.
  • Grading data from third-party grading companies, such as submission status, certification numbers, and assigned grades.
  • Social media data if you interact with our pages or accounts on third-party platforms, in accordance with those platforms' own privacy policies.

2.4 Information we do not intentionally collect

We do not ask for and do not want to receive your Social Security number, government identification number, financial account credentials, precise geolocation, biometric data, health information, or information about your race, religion, sexual orientation, immigration status, or political beliefs. Please do not send this information to us. If you send it anyway, we will delete it when we become aware of it.


3. Payments

Our online store and in-store point of sale are operated using Lightspeed commerce and retail software. Payment processing is handled by Lightspeed Payments and its underlying payment processor, and/or by other payment gateways we may enable.

When you pay us, your payment card details are transmitted directly to the payment processor. We do not receive, store, or have access to your full card number, CVV, or PIN. We receive only limited confirmation data such as the last four digits, card brand, expiration date, authorization status, and the amount charged.

Your payment information is handled under the payment processor's own privacy policy and its PCI-DSS obligations, in addition to this Policy.


4. How We Use Your Information

We use personal information for the following purposes:

  • To fulfill your orders — process purchases, take payment, package and ship items, arrange in-store pickup, and issue receipts.
  • To provide our services — accept and track grading submissions, process buy/trade offers, and issue payouts.
  • To communicate with you — respond to your questions, send order and grading status updates, confirm event registrations, and provide customer support.
  • To send marketing communications — but only where you have opted in, and only until you opt out. See Sections 5 and 6.
  • To operate and improve our website — maintain site functionality, understand which products and pages are popular, diagnose technical problems, and improve the shopping experience.
  • To prevent fraud and protect our business — verify orders, detect and investigate fraudulent transactions or counterfeit merchandise, enforce our terms, and protect the safety of our customers, staff, and property.
  • To comply with legal obligations — meet tax, accounting, recordkeeping, and reporting requirements, and respond to lawful requests from authorities.

We do not use your personal information to make decisions that produce legal or similarly significant effects about you through automated processing alone.


5. SMS / Text Messaging

Mo Bamba Cards & Collectibles offers text message (SMS/MMS) communication to customers who opt in. By providing your mobile phone number and checking the consent box on our in-store checkout or grading submission form, or by texting our business number, you consent to receive text messages from Mo Bamba Cards & Collectibles regarding your orders, card grading submissions, store events, and — if you separately opt in — new product announcements.

Consent to receive text messages is not a condition of any purchase.

Message frequency varies and is typically fewer than four messages per month. Message and data rates may apply.

You may opt out at any time by replying STOP to any message. You will receive a single confirmation message and no further messages after that. Reply HELP for assistance, or contact us at (512) 254-4278 or sean@mobambacollects.com.

We do not sell, rent, or share mobile phone numbers or SMS consent data with any third party or affiliate for their own marketing or promotional purposes. Mobile information collected for SMS purposes will not be shared with third parties for marketing or promotional purposes. Mobile numbers may be processed by our telecommunications service provider solely for the purpose of delivering the messages you have requested.

Carriers are not liable for delayed or undelivered messages.


6. Email Marketing

If you sign up for MoBamba News, we will send you occasional emails about new product drops, events, and sales. Every marketing email contains an unsubscribe link, and you may unsubscribe at any time. Unsubscribing from marketing email does not stop transactional messages such as order confirmations, shipping notices, or grading status updates, which are necessary to complete the service you requested.


7. Cookies and Tracking Technologies

We and our service providers use cookies, pixels, and similar technologies to operate the site and understand how it is used.

  • Strictly necessary cookies keep you logged in, remember the contents of your cart, and secure your checkout. The site will not function correctly without these.
  • Analytics cookies help us understand which pages and products are viewed, so we can improve the site.
  • Advertising and retargeting cookies, if enabled, may be used to show you our products on other websites and social platforms.

Most browsers let you refuse or delete cookies through their settings. Blocking strictly necessary cookies may prevent checkout from working.

Global Privacy Control: We recognize the Global Privacy Control (GPC) browser signal. If your browser or extension sends a GPC signal, we will treat it as a request to opt out of the sale of personal data and of processing for targeted advertising.


8. How We Share Your Information

We share personal information only as described below. We do not sell your personal information for money.

  • Service providers. We share information with vendors who perform services for us, including our commerce and point-of-sale platform (Lightspeed), payment processors, shipping carriers, email marketing providers, our telephone and text messaging provider (Zoom), website hosting providers, and analytics providers. These vendors are permitted to use your information only to perform services for us.
  • Third-party grading companies. If you submit cards for grading, we share the information necessary to complete that submission with the grading company you selected.
  • Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction. We will notify you if your information becomes subject to a materially different privacy policy.
  • Legal and safety. We may disclose information when we believe in good faith that disclosure is required by law, or is necessary to enforce our terms, investigate fraud or counterfeiting, or protect the rights, property, or safety of our customers, our staff, or the public.
  • With your direction. We will share information with anyone else when you ask us to.

Targeted advertising: If we use advertising or retargeting tools, sharing data with those platforms may be treated as a "sale" or as "targeted advertising" under some state privacy laws. You may opt out at any time using the contact details in Section 15 or by sending a Global Privacy Control signal.


9. Data Retention

We keep personal information only as long as we need it:

  • Order and transaction records — retained for at least the period required by federal and Texas tax and accounting rules, generally seven years.
  • Grading and buy/trade records — retained for as long as necessary to complete the service and resolve any dispute, and then for our standard records period.
  • Account information — retained while your account is open and for a reasonable period afterward.
  • Marketing contact information — retained until you opt out, after which we keep a minimal suppression record so we do not contact you again by mistake.
  • Website analytics data — retained on a rolling basis, typically no more than 26 months.

When information is no longer needed, we delete it or de-identify it.


10. Security

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit, access controls limiting staff access to what their role requires, and reliance on PCI-DSS compliant payment processors so that card data never reaches our systems.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If you believe your account has been compromised, contact us immediately at sean@mobambacollects.com.


11. Your Privacy Rights

11.1 Texas residents

Under the Texas Data Privacy and Security Act, Texas residents have the right to:

  • Confirm and access — confirm whether we are processing your personal data and obtain a copy in a portable, readable format.
  • Correct — correct inaccuracies in your personal data.
  • Delete — request deletion of personal data you provided or that we obtained about you.
  • Opt out — opt out of processing for targeted advertising, the sale of personal data, or profiling that produces legal or similarly significant effects.
  • Be free from retaliation — we will not deny you goods or services, charge you a different price, or provide a lesser quality of service because you exercised these rights.

How to exercise them: Email us at sean@mobambacollects.com with the subject line "Privacy Request," or call (512) 254-4278, or write to us at the address in Section 15. We may need to verify your identity before acting, which usually means confirming information already associated with your account or order.

Our timeline: We will respond without undue delay and no later than 45 days after receiving your request. We may extend this by an additional 45 days where reasonably necessary, and we will tell you before we do.

Authorized agents: You may use an authorized agent to submit an opt-out request on your behalf. We may require proof of the agent's authority.

Appeals: If we decline your request, we will explain why. You may appeal that decision within a reasonable period by replying to our response or emailing sean@mobambacollects.com with the subject line "Privacy Appeal." We will respond to your appeal in writing within 60 days. If we deny the appeal, we will provide you with a method to contact the Texas Attorney General to submit a complaint, at https://www.texasattorneygeneral.gov.

11.2 Residents of other states

If you live in a state with a comprehensive privacy law — including California, Colorado, Connecticut, Virginia, and others — you may have similar rights to access, correct, delete, and opt out. We extend the rights described above to all customers regardless of where you live. Use the same contact methods to make a request.

Notice for California residents: We do not sell personal information for monetary consideration, and we do not knowingly sell or share the personal information of consumers under 16 years of age.


12. Children's Privacy

Our website and online store are intended for adults. We do not knowingly collect personal information from children under 13. If you are under 18, please do not make a purchase or submit personal information without the involvement of a parent or guardian.

If you believe a child under 13 has provided us with personal information, contact us at sean@mobambacollects.com and we will delete it promptly.

Minors are welcome in our retail store and at our community events. When a minor participates, we collect only what is necessary and, where appropriate, ask for a parent or guardian to provide contact information instead.


13. Third-Party Links

Our website may link to third-party sites, including grading companies, marketplaces, and social media platforms. We are not responsible for the privacy practices of those sites. Review their privacy policies before providing personal information.


14. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top. If we make material changes to how we use your personal information, we will provide more prominent notice, such as an email to subscribers or a banner on our website.
